With effect from Monday, 26 February, the Contract (Third Party Rights) (Scotland) Act 2017 comes into force. The PSG documents are in the course of being updated to reflect it and the following wording will be added to relevant contractual documents:


“This [Agreement] does not create any rights in favour of third parties under the Contract (Third Party Rights) (Scotland) Act 2017 to enforce or otherwise invoke any provision of this [Agreement] [or otherwise].”


Leases - Management Documentation

The purpose of the Management Documentation is to provide solicitors with standard forms of documents for use when dealing with the day to day management aspects of leased property, as distinct from dealing with the actual negotiation of a lease itself. The suite of documents therefore encompasses those required in connection with documenting rent reviews, dealing with renunciations and assignations, granting consents to assignations and subleases and the like.
